What does FCS (First Credit Services) do? — click to expand ▸
FCS operates as a first-party white-label collector — members think they're talking to Crunch, not a third party. Active across 81 FV clubs. $12/FTE/hour pricing model.

Days 1-7: 2 calls/day Days 8-30: 1 call/day Day 30+: monthly
Uses MAC (Manually Approved Calling) via TCN dialer — clicker agents initiate each call, qualifying as manual dial under TCPA. No ATDS. Geographic caller IDs with CNO whitelisting.
Blocked by Crunch corporate. FCS pushing for access — cites 15-25% recovery lift, has TCPA-compliant processes, $5M E&O policy, proposes short code. Decision pending with Hiba.

Phase 1 results (Jan 2025-May 2026): $4.79M total recovery · 8.16M outbound dials · 188.9K right-party contacts (21.3% RPC) · 176.9K inbound calls back · 3.38M emails · 529K accounts worked across 81 clubs.
Key gap: FCS stops active calling at day 30 (switches to monthly). From day 31 onward, only emails continue (every 3 days until day 57, then nothing).
The FV SMS layer (ours) replaces FCS calls & emails. Timing is deliberate: front-loaded in month 1 (54% of failed payments cure here, almost none after), sent Thu-PM/Friday so the pay link is in the member's pocket for payday and the weekend — when members self-pay 2–3x more — and dropped into the silence gaps (ACH-only after day 14, ACH+alt after day 28) where the billing engine has gone quiet. The SMS is the nudge; the member's tap on PayPage is the payment. We do NOT charge cards on weekends — outreach timing only.

Legal, compliance & authorization reference
1. Card network retry rules (Visa / Mastercard) ▸
Both cap retries at 15 per card per rolling 30-day window. Beyond 15th: $0.10/attempt fee, program penalties ~$5K/month.
2. NACHA / ACH rules ▸
3 attempts maximum (initial + 2 retries). After 3rd NSF return -> REVERSAL MODE, permanently off the draft list. ACH-primary with no alt = total silence from day 14 to RFC (~day 80).
4. The snack card — can we charge unslotted POS cards? ▸
Section 23: authorizes charging any form of payment the member has provided. Contractually appears authorized; caveats around vintages, revocation, chargebacks, and the 15/30 cap still apply.
